GREYHOUNDS AUSTRALASIA RULES (GAR)

PREFACE

These Rules are acknowledged and adopted wherever possible by the various Boards/Commissions throughout Australia and New Zealand in recognition of the need for uniformity and the ever increasing accessibility and transportability of Greyhounds nominating and racing outside their registered jurisdiction.

PART 1 – PRELIMINARY

 

DEFINITIONS

R1       In these Rules unless the context or subject matter otherwise indicates or requires:

"Act" means the relevant legislation pertaining to a jurisdiction relating to greyhound racing.

"advertise" means to publish whether in written or printed form, orally or by an electronic medium.

"appropriate race rug" means a rug or vest of a type and colour prescribed by the Board/Commission.

 “approved (AI) program” is the program associated with AFS, CSI and FSI in Australia and New Zealand and referred to in accordance with the procedures and conditions outlined in Schedule 3.

“approved controlling authority” means the Board/Commission or club, which is authorised within a country or more specifically within Australian state or territory law or ordinances to control thoroughbred, harness or greyhound racing in that jurisdiction.

"approved facility (AI)" means premises approved by the Board/Commission at which an approved (AI) program may be undertaken including, but not limited to recording, collection, storage, chilling, freezing of semen and insemination and from which an approved person may undertake the (AI) program.

“approved person” is a person approved and registered by the Board/Commission as such having regard to registration of a stud sire under Rule 161 for stud sire purposes other than by artificial insemination (AI).

"approved person’ (AI)" means a registered veterinarian or a person registered with the Board/Commission, and in both instances, is a person who has been approved by the Board/Commission under Rule 164 (4) to have undertaken an approved (AI) course.

"artificial insemination (AI)" means a process of insemination irrespective of the technique being undertaken as approved by the Board/Commission and includes the following methods – artificial insemination with fresh semen (AFS), chilled semen insemination (CSI) and frozen semen insemination (FSI).

‘artificial insemination with fresh semen (AFS) is an authorised process of insemination, performed by an approved person (AI) using a breeding unit, or the complete ejaculate, on site at the time of the semen collection.

"attendant" means a person registered by the Board/Commission other than a registered owner or trainer who is authorised to physically be in charge of a greyhound whilst such greyhound is on the premises of a club for racing and includes an owner-attendant.

"authorised person" means a person authorised or approved by the Board/Commission or the Stewards from time to time to do certain things, to exercise certain powers, or to deal with certain situations.

"Board/Commission" means the approved controlling authority or the legislated body having control of greyhound racing, or an aspect thereof, in accordance with the Act. – for the purposes of these Rules the terms ‘Board/Commission’ and ‘Authority’ are interchangeable.

“Board/Commission Rules” shall have a prefix containing the abbreviation of the GA Member before the Board/Commission Rule – e.g Board/Commission Rule 7 in Victoria should be identified as GRV7; in Queensland it would be GRA(Qld)7.

"bookmaker" means a person defined as such in the Act

"bookmaker's clerk" means a person defined as such in the Act

"box draw" means a random allocation process used to determine the respective boxes in which greyhounds are to be placed

‘breeding unit’ means a specific unit being either a complete ejaculate or an ejaculate which has been split from a complete ejaculate. Each breeding unit which is resultant from a split must contain a certified minimum number of not less than 200 million forwardly motile, normal live sperm taken at the time of collection. Breeding units may be used for AI processes using artificial insemination with fresh semen (AFS), chilled semen insemination (CSI) or frozen semen insemination (FSI).

"certificate of registration" means an identification document in respect of a greyhound issued by the Board/Commission

"Chairman of Stewards" means a person appointed to that position by the Board/Commission.

"Chief Steward" means a person appointed to that position by the Board/Commission.

‘chilled semen insemination’ (CSI) is an authorised process, performed by an approved person (AI) whereby a reconstituted breeding unit, which has been specifically chilled for that purpose, is used

‘chilling’ is an authorised process, performed by an approved person whereby a breeding unit is chilled or cooled for the purpose of preserving the semen for chilled semen insemination at a later date

"club" means a greyhound racing club as defined in the Act and registered or licensed by a Board/Commission, if so required, or a Board/Commission empowered to conduct greyhound racing.

"committee" means the managing body charged with the administration of the club or an administrator of a club appointed pursuant to the Act.

"coursing" means the competitive pursuit of a mechanical quarry by two (2) greyhounds or the pursuit by one (1) in the case of a bye.

"day" means the calendar day.

"dead-heat" means where two (2) or more greyhounds pass the finishing line simultaneously in an Event.

“defaulter” means a person, declared by the Board/Commission or an authorised person to be a defaulter, who is in default in respect to the payment of any money payable to:

(a)            the Board/Commission or a club, including any prize monies directed to be returned to the relevant Board/Commission or club; or

(b)           a person in respect of any unpaid bet.

"delegated person" means an owner who is a member of a syndicate and appointed by such syndicate to act for and on behalf of all members of the syndicate.

"disqualification" in relation to any person or greyhound means disqualified by a racing Board/Commission or Stewards or pursuant to the Rules of any thoroughbred racing or harness racing Board/Commission or club and "disqualified" has a corresponding meaning.

DNA’ means deoxyribonucleic acid.

‘DNA fingerprint analysis’ means the chemical process used for the purpose of identifying and ascertaining the biographical heritage or pedigree of an animal (greyhound) by resolving the partial digest of a DNA.

draw/drawing’ means the collection, by an approved person, of a full ejaculate of semen from a stud sire pursuant to the Rules.

"drug(s)" means:

(a)        any substance(s) capable of affecting a greyhound by its action on the central or peripheral nervous system or any part of that system such as the autonomic nervous system, cardiovascular system, respiratory system, alimentary digestive system, musculoskeletal system or genitourinary system and includes without limitation analgesics, antihistamines, anti-inflammatory agents, blood coagulants, diuretics, hormones and their synthetic counterparts, stimulants, corticosteroids, anabolic steroids, local anaesthetics, muscle relaxants and tranquillisers;

(b)       substance(s) administered to disguise or make undetectable, or attempt to disguise or make undetectable, the administration of any of the substance(s) referred to in paragraph (a);

(c)        a metabolite, isomer or artefact of any of the substance(s) referred to in paragraphs (a) or (b) irrespective of whether or not such metabolite, isomer or artefact has any pharmacological effect or not;

(d)       unusual or abnormal amounts of endogenous substance(s) including but not limited to cortisol and testosterone; and

(e)        any substance(s) specified in Schedules 1 to 9 inclusive of the Standard for the Uniform Scheduling of drugs and Poisons (Commonwealth) as amended from time to time.

"duty Steward” means a Steward performing duties at an Event in conjunction with or at the direction of the Steward in charge.

”Event" means a race, qualifying trial or in the case of a coursing meeting a "course", and includes a heat, semi-final, consolation or final of an Event.

‘fee means any fee payable pursuant to these Rules and includes the fees set out in Schedule 2 as may be amended from time to time by a Board/Commission.

‘fees Schedule’ means the Schedule 2 attached to these Rules.

‘freezing’ is an authorised process, performed by an approved person whereby a breeding unit is frozen for the purpose of preserving the semen for frozen semen insemination at a later date.

‘frozen semen insemination’ (FSI) is an authorised process, performed by an approved person whereby a reconstituted breeding unit, which has been specifically frozen for that purpose, is used. FSI is the use or proposed use of semen which has been previously obtained from a greyhound then frozen for later use for breeding purposes and includes (but is not limited to):

(a)                collection of semen;

(b)               assessment of semen;

(c)                freezing of semen;

(d)               storage of semen;

(e)                thawing of semen; and

(f)                 insemination of thawed semen into a greyhound bitch,

all in relation to or for the purposes associated with greyhound frozen semen use or requirements.

“GAR” means the Greyhounds Australasia Rules promulgated by Greyhounds Australasia Ltd being a body constituted in September 2003 (and formerly known as the Australia and New Zealand Greyhound Association or ANZGA) to provide an efficient forum to facilitate a uniform, responsive and binding decision making process that maximises returns to the greyhound industry and ensures the integrity and fair conduct of greyhound racing throughout Australia and New Zealand.

“greyhound” means a dog or bitch of the species and in respect to these Rules means a greyhound registered or licensed with the Board/Commission pursuant to their Rules. 

“greyhound racing” means everything and anyone who participates, at any level, at any time, with any activity associated with greyhounds or racing and includes, but is not limited to:

(a)    the keeping of greyhounds which are in the care or custody of registered or other persons;

(b)   the registration and breeding of greyhounds;

(c)    any matter or thing connected with greyhound racing.

“Greyhounds Australasia Rules” means the rules developed and approved by Greyhounds Australasia Ltd (or any successor to that body by whatever name called) as amended and in force from time to time. For the purposes of clarity Greyhounds Australasia Rules shall replace the former AGRR and may be denoted by the prefix GAR to distinguish from other Rules.

"ill" includes suffering from a disease or any fungal viral, bacterial, parasitic or other condition whether it be contagious or not and "illness" shall have a corresponding meaning.

‘identification system’ means the manner by which stud sires, the storage system and breeding units of semen are identified, as approved by the Board/Commission from time to time

‘inseminator’ means a person approved by a Board/Commission to conduct and supervise artificial insemination pursuant to these Rules.

“inventory system’ means the manner by which containers are logged and accounted for.

"in season" means those times when a greyhound bitch is in heat/oestrus and includes the term “seasonal condition”.

“keeper of the stud book” means the person appointed by Greyhounds Australasia who is responsible for:

(a)            compiling of all information relative to the whelping of greyhound litters;

(b)           monitoring, approving and where required naming greyhounds admitted into the studbook; and

(c)            publishing, revising and updating the studbook

“Local Rules” shall have a suffix containing the abbreviation of the GA member after the letters LR – eg Local Rule 7 in New South Wales should be identified as LR7(NSW) and in Queensland as LR7(Qld). It is recognised that legislation pertaining to individual Members of GA may prevent the total adoption of all of the GAR. In these cases individual members will adopt Local Rules (LR) to provide for such legislative requirements.

"lure" means an artificial device activated by mechanical or electronic means.

"mar” or “marring” means the act of a greyhound which deliberately turns the head and makes head or muzzle contact with another greyhound.

“marking official” means a person appointed by the Board/Commission to perform any of the functions listed in Rule 151.

"meeting" means any occasion at which greyhound racing is scheduled to be conducted pursuant to these Rules.

"month" means calendar month.

"muzzle" means a guard or strap of a type approved by the Board/Commission.

“natural service” means the physical mating of a greyhound bitch and a greyhound sire for the purposes of breeding, and does not include AFS, CSI, FSI or any other type of artificial insemination.

"nomination" means the submission of an entry in respect of a greyhound for a meeting or an Event.

"officer of the Board/Commission" means a person authorised by the Board/Commission either generally or in a particular instant to make Inquiries, give directions or carry out any activity pursuant to these Rules or by direction of the Board/Commission and shall include a Steward.

"official" means any person (by whatever name called) appointed to officiate at a meeting as, or to carry out similar duties to, a secretary, Steward, judge, assistant judge, supervisor (including betting), attendant (kennel, track or general), starter, assistant starter, lure driver, veterinary surgeon, clerk (prices) or in any other official capacity directly connected with the conduct of a meeting.

"owner" includes any person who has a legal or equitable interest in a greyhound and includes a lessee.

"owner/trainer" means an owner who trains a greyhound of which he is an owner or part owner, or who trains a greyhound owned by any person residing with the owner/trainer where such an arrangement is allowed by the Board/Commission.

"parade area" means the enclosed area set aside for the parading of greyhounds prior to the commencement of an Event.

“partnership” means an association of persons registered for that purpose and may include a syndicate or confederacy.

"penalty" includes (without limitation) a fine, disqualification, suspension, warning off, cancellation of registration, declaration of defaulter, order of prohibition and any other determination, decision, order or other matter imposed or made pursuant to these Rules by which a person or a greyhound suffers or incurs a disadvantage, detriment or any restriction whatsoever.

"person" means any person or body corporate whether registered by the Board/Commission or not.

"premises  of  a club” means :

            (a)        the area as defined by specific lease or registered title as being in the ownership of a club; or

            (b)        described as and including, but not limited to, any building or structure identified as the club’s offices;

            (c)        that general area used for the purposes of conducting greyhound racing meetings or trialling;

            (d)        including the area where an admission fee is normally charged to gain entry for greyhound racing; and

            (e)        the area, if any, set aside as a trainers, owners or bookmakers car park.

"prescribed" means such system as the Board/Commission may from time to time prescribe or require.

prescribed Form” means any form listed in Schedule 1 to these Rules.

"prize money" includes any monies, rewards, trophies or consideration whatsoever for competing in an Event.

"proprietor" means the owner or occupier of any land which is utilised or intended to be utilised as a greyhound trial track.

“publish” means:

(a)        to cause to be printed in any newspaper, other publication or elsewhere by whatever means available including any internet service or facility; or

(b)        to otherwise announce publicly.

"qualifying trial" means the competitive pursuit of a lure by one (1) or more greyhounds in a trial held under conditions prescribed by the Board/Commission and by which the eligibility of greyhounds to be nominated for an Event is determined.

“quarter” means the periods January – March inclusive, April – June inclusive, July – September inclusive and October – December inclusive.

"race" means the competitive pursuit by one (1) or more greyhounds of a lure in a greyhound Event as defined in the Act other than a course or qualifying trial.

"Racing Board/Commission" means the entity charged pursuant to the law of a country, state or territory with the control of greyhound racing within such country, state or territory.

“racecourse" means land and environs used for the purposes of greyhound racing meetings

‘registered person/licensee’ for the purposes of these rules the terms are interchangeable and shall mean a person registered or licensed with the Board/Commission pursuant to their Rules.

"registered address" means the residential address of a registered person recorded by the Board/Commission.

"Registration Board/Commission" means the entity charged pursuant to the law of a country, state or territory with the registration of greyhounds.

"reserve greyhound” means a greyhound listed as a reserve for an Event.

"reserve box draw" means the random allocation process whereby such of the reserve greyhounds and the respective boxes in which they shall be placed in order to commence the meeting is determined and includes Events conducted by way of a heat, semi-final or final.

“reside” means domiciled in or having a permanent place of abode.

"satisfactory trial" means a trial required to be performed by a greyhound to the satisfaction of the Stewards pursuant to Rule 102.

“service” includes a natural service, an artificial insemination with fresh semen, a chilled semen insemination, a frozen semen insemination and the collection of semen from a stud sire by an approved person (AI) for the purpose of conducting an artificial insemination by means of a breeding unit.

"Steward" means a person appointed or approved by the Board/Commission to carry out such duties as directed by the Board/Commission, the Chief Steward or the Chairman of Stewards.

"Steward in charge of the meeting" means a person designated to be in charge of a meeting.

“stud book” means the Greyhounds Australasia stud book published by GA from time to time.

“studmaster” means a person registered with the Board/Commission who has the care, control, custody or supervision, whether delegated or not, of a stud sire.

“stud sire” means a male greyhound registered as a stud sire with the Board/Commission.

 “suspension” in relation to any person, means the withdrawal for any period of any registration, licence, right or privilege granted under these Rules and, in relation to any person, “suspend” has a corresponding meaning.

“suspension” in relation to a greyhound means for such period as may be specified under these rules; and in relation to a greyhound, “suspend” has a corresponding meaning.

“syndicate” means a partnership referred to in Rule 169

“track” means that part of a racecourse known as the race track and on which greyhounds actually compete at a meeting.

"trainer" means a person who for fee, reward or any consideration trains a greyhound and includes an owner-trainer.

“Tribunal” means an appeals Tribunal defined as such in the Act.

"veterinary surgeon" means a qualified veterinary surgeon registered under the appropriate legislation in the country, state or territory in which the meeting is conducted.

"walkover" means an Event referred to in Rule 93

“warned off” shall have the corresponding meaning to that of disqualification.

"weight trial" means a trial required to be performed by a greyhound to the satisfaction of the Stewards pursuant to Rule 46.

“whelping trial” means a satisfactory trial in the presence of the Stewards by a greyhound bitch that has whelped a litter but not within ten (10) weeks of that whelping.

CONSTRUCTION

R2.      In these Rules unless the context or subject matter otherwise indicates or requires:

(1)        words importing the singular include the plural and vice versa;

(2)        words importing any gender include the other genders;

(3)        words importing persons include all bodies and associations corporate or unincorporated;

(4)        any reference to these Rules or to a statute, ordinance, code or other law includes any rules, orders, regulations, instruments or other sub-ordinate legislation made under it and consolidations, amendments, re-enactments or replacements or any of them (whether of the same or any other legislative Board/Commission having jurisdiction);

(5)        expressions cognate with expressions defined in the definitions section shall be construed accordingly.

(6)        words defined in the Board's/Commission’s Rules shall have the same meaning where used in these Rules except where the contrary is indicated.

R3       (1)        (a)        The Rules of a Board/Commission and/or the Local Rules of a Board/Commission take precedence over the Greyhounds Australasia Rules (GAR).

            (b)        If a GAR  is  amended in any way from time to time (including by addition or deletion or any new rule), then such amendment must be adopted by a resolution of a Board/Commission before it is deemed to apply in that jurisdiction.

(2)        In the event of the application of the Rules of a Board/Commission or the Local Rules of a Board/Commission other than these Rules;

(a)                The Board/Commission Rules shall apply and form part of these rules;

(b)               The Local Rules shall apply and form part of these Rules.

PART 2 – POWERS OF BOARD/

COMMISSION, OFFICERS & STEWARDS

R4       (1)        The Board/Commission may, without derogation of any of the powers set out in the Act or otherwise provided for in these Rules, apply the following;

(a)        Every member of a club and every person who takes part in any matter coming within these Rules, the Rules of a Board/Commission and any Local Rules shall be deemed to have knowledge that all of the Rules are in existence for the control, regulation and conduct of anything pertaining to greyhound racing including, but not limited to, greyhound race meetings or qualifying trials held by a club and shall thereby consent to be bound by them.

(b)        A Board/Commission shall cause to be made publicly known to registered participants and clubs any amendment, variation or addition to these Rules, the Rules of a Board/Commission and any Local Rules of any such resolution or resolutions and the same shall become effective from a date so indicated.

(2)               The Board/Commission may

(a)        appoint for a purpose any number of persons as Stewards, and/or, authorised persons (whether generally or in a specific case).

(b)        revoke the appointment of a Steward, and/or an authorised person at any time.

(3)        The Board/Commission may conduct an inquiry into any matter concerning the racing, breeding or registration of greyhounds or any other function for which the Board/Commission is responsible under the Act.

(4)        The Board/Commission may at such time, date and place specified by the Board/Commission require the attendance of and the giving of evidence by any registered person or any other person participating in or associated with greyhound racing who, in the opinion of the Board/Commission, may have knowledge of any of the matters which are the subject of an inquiry under sub-rule (3)
